NotMyDress – Rental Agreement & Terms of Service (NZ)

By placing an order with NotMyDress (“we”, “us”, “our”), you agree to be bound by these Terms & Conditions (“Terms” or “Rental Agreement”).

1. BASIC RENTAL AGREEMENT

1.1 Ownership
All rental garments remain the legal property of NotMyDress at all times.

1.2 Right to Wear
When you rent from us, you are purchasing the right to wear the garment for the agreed Rental Period only.

1.3 Rental Period
The Rental Period:

  • Begins on the selected event date (or stated start date), and

  • Ends on the stated return date (usually the next working day).

Your right to possess the garment ends on the return date.

1.4 Responsibility
You are fully responsible for the garment from:

  • The time it is delivered (delivery scan confirmation), or

  • The time it is collected,

Until it is received back by NotMyDress.

 

2. ELIGIBILITY

  • You must be 18 years or older to enter this agreement.

  • If under 18, a parent or legal guardian must agree to these Terms.

  • You confirm all information provided is accurate.

3. BOOKINGS & PAYMENT

3.1 Payment Required
Full payment (including rental fee, shipping and any bond if applicable) is required to secure a booking.

We do not hold garments without payment.

3.2 Pricing
All prices are in New Zealand Dollars (NZD) and include GST where applicable.

3.3 Authorisation to Charge
By placing an order, you authorise NotMyDress to charge your payment method for:

  • Late fees

  • Damage/repair fees

  • Cleaning fees

  • Replacement costs (up to full RRP)

  • Loss of income from cancelled future bookings

4. DELIVERY & SHIPPING

4.1 Courier Use
We use third-party courier services (NZ Post). Delivery timeframes are estimates only and not guaranteed.

4.2 Risk & Responsibility
Once tracking shows delivered to the address provided, the garment is your responsibility.

4.3 Incorrect Address
If incorrect shipping details are entered, you may be liable for replacement costs.

4.4 Courier Delays
We are not liable for delays caused by:

  • Courier network issues

  • Redirection requests

  • Failure to collect from depot

  • Rural misclassification

  • Late previous renters

Refunds for courier delays are assessed case-by-case.

 

5. GARMENT CONDITION

5.1 Rental Nature
NotMyDress is a rental company. Garments are pre-worn and may show minor signs of wear.

5.2 Expected Wear Includes

  • Minor loose threads

  • Micro pulls

  • Small stitching imperfections

  • Very minor marks

5.3 Condition Rankings (if you choose to use them)
You may categorise garments (e.g. Perfect, Very Good, Good, Loved).

5.4 Listed Flaws
If a flaw is disclosed in the product description, no refund will be offered for that flaw.

 

6. GARMENT CARE & DAMAGE

6.1 You Must Not:

  • Wash or dry clean the garment

  • Alter, tailor or iron it

  • Attempt stain removal

  • Sub-rent or lend it

6.2 Damage Responsibility
You are liable for:

  • Stains (including fake tan, makeup, wine)

  • Tears, burns or pulls

  • Missing embellishments

  • Permanent odours

  • Irreparable damage

6.3 Cleaning Costs
Minor cleaning is covered.
Excessive cleaning or specialist treatment will be charged to you.

6.4 Repairs or Replacement
If repairable — you pay repair cost.
If irreparable — you may be charged up to 100% of RRP.

If full RRP is paid, ownership of the damaged garment may transfer to you.

6.5 Assessment
All damage assessments are made reasonably at our discretion based on:

  • Repair cost

  • Replacement cost

  • Lost rental income

7. LOSS, THEFT & NON-RETURN

If a garment is:

  • Not returned,

  • Lost, or

  • Stolen while in your possession,

You will be invoiced up to 100% of the garment’s RRP plus any lost income from cancelled bookings.

If unpaid after 5 working days, we reserve the right to pursue recovery through:

  • Debt collection

  • Disputes Tribunal

  • Legal action

You are responsible for all recovery costs.

 

8. RETURNS

8.1 Postal Returns

  • Must be returned using the prepaid satchel provided.

  • Must be dropped at an NZ Post counter (not a letterbox).

  • Must be lodged by 4pm on the return date.

8.2 Incorrect Return Methods
Late fees apply if:

  • Economy post is used

  • Letterbox drop is used

  • Returned via third parties

  • Posted after the due date

8.3 Pick-Up Rentals
Must be returned to the agreed location on the return date.

 

9. LATE FEES

Late returns incur:

  • $20 per day (or amount you choose), AND/OR

  • Compensation for any cancelled subsequent rental.

Late payment of invoices may also incur additional fees.

10. ISSUES ON RECEIPT

If your garment arrives damaged beyond normal wear:

  • You must notify us within 24 hours of delivery with photos.

  • The garment must remain unworn.

  • It must be returned immediately.

If worn to your event, you accept the garment’s condition.

No refunds are offered for:

  • Fit or sizing issues

  • Change of mind

  • Not wearing the garment

11. CANCELLATIONS

11.1 Within 24 Hours of Booking
Full refund if:

  • Item has not been packed, and

  • Event date is not within 3 working days.

11.2 After 24 Hours
Store credit (12 months validity) if cancelled before dispatch.

11.3 After Dispatch
No refunds or credits.

12. BUY NOW / SALE ITEMS

All BUY NOW or Ex-Rental purchases are final sale unless faulty under the Consumer Guarantees Act 1993.

13. LIMITATION OF LIABILITY

To the maximum extent permitted by NZ law:

  • We are not liable for indirect or consequential loss (including missed events).

  • Our total liability is limited to the rental fee paid.

Nothing in these Terms limits your rights under:

  • Consumer Guarantees Act 1993

  • Fair Trading Act 1986

14. WEBSITE USE

You must not:

  • Use the website unlawfully

  • Upload malicious code

  • Provide false information

  • Infringe intellectual property

We may terminate service at our discretion.

15. PRIVACY

We collect and store personal information in accordance with:

  • Privacy Act 2020 (NZ)

Personal information may be used to recover unpaid debts or missing garments.

16. TERMINATION

We may terminate or refuse service:

  • If you breach these Terms

  • If fraudulent activity is suspected

  • If identification is not provided upon request

Obligations relating to damage, payment, and recovery survive termination.

17. GOVERNING LAW

These Terms are governed by the laws of New Zealand.

Disputes will be handled in New Zealand courts or the Disputes Tribunal.
